Welke van uw gegevens verwerken wij en voor welke doeleinden? Wat gebeurt er als u ons de gegevens niet meedeelt?

Wij verwerken de gegevens die u ons in het kader van uw sollicitatie meedeelt om uw geschiktheid voor de functie of, in voorkomend geval, voor andere openstaande functies binnen onze bedrijvengroep na te gaan en om de sollicitatieprocedure uit te voeren. Daarnaast ontvangen wij persoonsgegevens van onafhankelijke wervingsbureaus die reeds met u in contact staan.

Als onderdeel van uw sollicitatie dient u alleen de persoonsgegevens te verstrekken die noodzakelijk zijn voor een sollicitatie (bijvoorbeeld: sollicitatiebrief, CV, referenties). Als u ons deze gegevens niet verstrekt, kunnen wij uw sollicitatie niet in behandeling nemen.

Op welke rechtsgrondslag en voor welke doeleinden verwerken wij de gegevens?

De rechtsgrondslag voor de verwerking van uw persoonsgegevens in het kader van de sollicitatieprocedure is § 26 van de Duitse Bundesdatenschutzgesetz (BDSG), art. 6, lid 1, onder b) van de AVG, namelijk de uitvoering van precontractuele maatregelen.

De rechtsgrondslag voor de verwerking van uw persoonsgegevens kan ook uw toestemming zijn, Art. 6 (1) a) van de AVG.

De rechtsgrondslag voor de verwerking van uw persoonsgegevens blijft de bescherming van de gerechtvaardigde belangen van ons of van derden, Art. 6 (1) f) van de AVG. Wij streven met name de volgende legitieme belangen na:

de positie invullen met de best mogelijke kandidaat;
proactief gebruik van kandidatenportalen en professionele netwerken;
het indienen van juridische claims en het voeren van verweer in juridische geschillen.

Hoe lang worden de gegevens bewaard?

Gegevens die voor de hier uiteengezette doeleinden worden verzameld, worden slechts bewaard zolang dat nodig is voor een bepaalde toepassing en gedurende een overgangsperiode (d.w.z. zolang dat nodig is om te voldoen aan onze verplichtingen inzake gegevensbewaring krachtens de toepasselijke wetgeving of zolang de bewaring van de gegevens wettelijk is toegestaan). In beginsel worden de gegevens van sollicitanten 6 maanden na het einde van de sollicitatieprocedure gewist.

Indien u hebt ingestemd met de verdere opslag van uw persoonsgegevens, zullen wij uw gegevens overdragen aan onze kandidatenpool. Daar worden de gegevens na twee jaar gewist. Indien u de aangeboden functie krijgt toegewezen, worden uw gegevens van het systeem voor sollicitanten overgebracht naar ons systeem voor personeelsbeheer en daar verwerkt.

Aan welke ontvangers worden de gegevens doorgegeven?

Binnen ons bedrijf wordt toegang tot uw gegevens verleend aan de afdelingen die deze nodig hebben om de hierboven vermelde doeleinden te bereiken.

De door ons gebruikte verwerkers (art. 28 AVG) kunnen gegevens ontvangen voor de hierboven vermelde doeleinden. Dit zijn bedrijven in de categorieën IT-diensten (vooral software voor de aanvraagprocedure) en personeelsdiensten.

Wij zijn een Chinese bedrijvengroep. In het kader van de gegevensuitwisseling binnen de groep voor de bovengenoemde doeleinden, ontvangen de volgende ontvangers uw gegevens:

Waar worden de gegevens verwerkt?

De gegevens worden zowel binnen de Europese Unie of de Europese Economische Ruimte (EER) als in andere derde landen, met name China, verwerkt. Om uw gegevens te beschermen en een adequaat beschermingsniveau voor uw persoonsgegevens te bereiken, zijn wij EU-normclausules inzake gegevensbescherming overeengekomen met ontvangers van uw gegevens buiten de EER - voor landen zonder een besluit van de Europese Commissie inzake adequaatheid krachtens artikel 45 van de AVG. U hebt de mogelijkheid om een kopie van deze EU-standaardclausules inzake gegevensbescherming te verkrijgen of om ze in te zien. Indien nodig kunt u contact opnemen met: dpo@mgmotor.eu

Uw rechten als “betrokkene”

Elke betrokkene heeft

het recht op informatie volgens art. 15 van de AVG(d.w.z. dat u het recht hebt om op elk moment informatie op te vragen over uw persoonsgegevens die door ons zijn opgeslagen),
het recht op rectificatie overeenkomstig art. 16 van de AVG(d.w.z. indien uw persoonsgegevens onnauwkeurig of onvolledig zijn, kunt u verzoeken om rectificatie van deze gegevens),
het recht op wissing overeenkomstig artikel 17 van de AVG en het recht op beperking van de verwerking overeenkomstig artikel 18 van de AVG(d.w.z. dat u het recht kunt hebben om te verzoeken dat de verwerking van uw persoonsgegevens wordt gewist of beperkt indien er bijvoorbeeld niet langer een legitiem zakelijk doel is voor een dergelijke verwerking en wettelijke bewaarplichten de verdere opslag niet vereisen),
het recht op gegevensoverdraagbaarheid uit hoofde van artikel 20 van de AVG(d.w.z. dat u het recht kunt hebben om de u betreffende persoonsgegevens die u ons hebt verstrekt in een gestructureerd, algemeen gebruikt en machineleesbaar formaat te ontvangen en deze gegevens zonder belemmeringen aan een andere verwerkingsverantwoordelijke over te dragen).

Bovendien kunt u uw toestemming intrekken, in beginsel met werking voor de toekomst.

Bovendien hebt u het recht om een klacht in te dienen bij de bevoegde toezichthoudende autoriteit (art. 77 AVG), met name in het land waar u permanent verblijft of in het land waar de vermeende inbreuk op de AVG heeft plaatsgevonden.

Bovendien willen wij u wijzen op uw recht van bezwaar overeenkomstig artikel 21 van de AVG:

U hebt het recht om te allen tijde, op grond van redenen die verband houden met uw bijzondere situatie, bezwaar te maken tegen de verwerking van uw persoonsgegevens door ons en u kunt verzoeken dat de u betreffende persoonsgegevens niet langer worden verwerkt. Dit geldt ook voor profilering op basis van deze bepaling in de zin van artikel 4, lid 4, van de AVG. Indien u over een recht van verzet beschikt en dit recht uitoefent, zullen uw persoonsgegevens niet langer voor die doeleinden worden verwerkt. Het bezwaar kan zonder formaliteiten worden ingediend en is gratis.

In hoeverre is er sprake van geautomatiseerde besluitvorming in individuele gevallen, met inbegrip van profilering?

In het kader van contact met ons via een formulier of e-mail maken wij geen gebruik van volledig geautomatiseerde besluitvorming in de zin van artikel 22 van de AVG. Wij verwerken uw gegevens ook niet automatisch met het doel bepaalde persoonlijke aspecten te evalueren (profilering).

Which of your data do we process and for what purposes? What happens if you do not provide us with the data?

We process the data that you send us in connection with your application in order to check your suitability for the position or, if applicable, other open positions in our group of companies and to carry out the application procedure. In addition, we receive personal data from independent recruitment consultancies that are already in contact with you.

In the context of your application, you should only provide the personal data that is necessary for an application (for example: cover letter, CV, references). If you do not provide us with this data, we will not be able to process your application.

On what legal basis and for what purposes do we process the data?

The legal basis for the processing of your personal data in the application process is Art. 6 para. 1, b) GDPR, namely in order to take steps at the request of the applicant prior to entering into a contract.

The legal basis for the processing of your personal data may also be your consent, Art. 6 para 1 a) GDPR.

The legal basis for the processing of your personal data continues to be the legitimate interests of us or of third parties, Art. 6 para 1 f) GDPR. In particular, we pursue the following legitimate interests:

Finding the best possible candidate,
Proactive use of applicant portals and professional networks,
Assertion of legal claims and defence in legal disputes.

How long will we store your data?

Data collected for the purposes set out here will only be retained for as long as is necessary for a particular application and for a transitional period (i.e. as long as compliance with our obligations regarding data retention under applicable law so requires or as long as retention of the data is permitted by law). In principle, data of applicants will be deleted 6 months after the end of the application process.

In the event that you have agreed to further storage of your personal data, we will transfer your data to our applicant pool. There, the data will be deleted after two years. Should you get the advertised job, your data will be transferred from the applicant data system to our personnel management system.

With whom do we share your data?

Within our company, access to your data is granted to those departments that need it to fulfil the above-mentioned purposes.

Service providers instructed by us may also receive data in this context. These are companies that fall within the categories of IT services (especially applicant software for the application process) and Human Resources Services.

We are a Chinese group of companies. Within the scope of the intra-group data exchange for the above-mentioned purposes, the following recipients receive your data:

Where do we process the data?

The data is processed both within the European Union or the European Economic Area (EEA) and in other third countries, in particular China. Please note that in order to protect your data and to achieve an adequate level of protection for your personal data, we have agreed on EU standard contractual clauses with recipients of your data in countries outside the EEA and without an adequacy decision by the European Commission pursuant to Article 45 GDPR. Your Rights

You may have the following rights in relation to your data

Right of access pursuant Art. 15 GDPR – you have a right to request access to your personal data stored by us,
Right of rectification (correction) pursuant Art. 16 GDPR – you have the right to ask for your personal data to be corrected if it is inaccurate, and completed if it is incomplete,
Right to erasure pursuant Art. 17 GDPR and Right to restriction of processing pursuant Art. 18 GDPR – i.e. You may have the right to request the deletion or restriction of processing of your personal data if, for example, there is no longer a legitimate business purpose for such processing and legal retention obligations do not require further storage of the data,
Right to data portability pursuant Art. 20 GDPR - i.e. you may have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format and to transmit this data to another controller without hindrance.

Furthermore, you can withdrawal consent, in principle with effect for the future.

In addition, you have the right to lodge a complaint with the competent supervisory authority (Art. 77 GDPR), in particular in the country of your permanent residence or in the country where the alleged breach of the GDPR occurred.

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you by us and you may request that personal data concerning you no longer be processed. If you have the right to object and exercise this right, personal data concerning you will no longer be processed for these purposes. The objection can be made form-free and is free of charge.

Is there in place any automated decision-making in individual cases, including profiling?

When contacting you by form or email, we do not use fully automated automatic decision-making pursuant to Article 22 GDPR. We also do not process your data automatically with the aim of evaluating certain personal aspects (profiling).
