Pre-contractual Information
This document contains the pre-contractual information pursuant to Art. 3(2) and (3) of the EU Data Act.
Overview
The EU Data Act (Regulation EU 2023/2854, available here: EU Data Act) requires manufacturers of connected products, as of 12 September 2025, to provide users with clear and understandable information about the data generated by the product and its handling before the contract is concluded.
Connected products are items that generate or collect data during use and communicate via a network. This includes all MG vehicles offered in the EU that are equipped with the MG iSMART connectivity system.
MG Motor (SAIC Motor Europe B.V., Oval Tower, 15th floor, De Entree 159, 1101 HE Amsterdam, Netherlands) provides the required pre-contractual information pursuant to Art. 3 EU Data Act below – structured separately for (1) the vehicles themselves and (2) the related services.
1. Pre-contractual Information on Connected Products (Art. 3(2) EU Data Act)
Data categories
Connected MG vehicles, via the MG iSMART connectivity system, collect various categories of data during operation – provided the user has entered into an End User Licence Agreement (EULA) – including but not limited to:
Basic vehicle data: e.g. Vehicle Identification Number (VIN), model designation, engine number.
Vehicle status data: fuel or battery capacity, remaining range, tyre pressure, engine and system states (doors/windows, temperature), climate control settings, start/end of trip, mileage.
Location data: GPS data for functions such as “locate vehicle”, driving routes, navigation destinations (when route planning is used).
Battery data: state of charge (%), remaining charging time, charging power and voltage for electric vehicles.
Diagnostic data: error codes, maintenance needs, vehicle and component temperatures.
Communication data: push notifications and alert messages sent to user devices.
All data is processed electronically and in structured, machine-readable formats (e.g. JSON, CSV). The data volume depends on usage and driving time. Based on technical experience, the amounts are relatively small, typically less than 1 MB per operating hour.
Continuous and real-time generation
Vehicles equipped with MG iSMART can generate data continuously and in real time while driving and with an active online connection.
Storage and retention
Data is stored in the vehicle for a short period of time (e.g., in control units) and - to the extent necessary for the provision of MG iSMART services - transferred to an MG iSMART server in Paris, France, provided that a valid MG iSMART end user license agreement is in place. Data is stored there as long as necessary to provide the respective MG iSMART services and for compliance with contractual or legal obligations. Data will be deleted at the latest upon deletion of the MG iSMART account.
2. Pre-contractual Information on Related Services (Art. 3(3) EU Data Act)
iSMART App & data categories
MG Motor offers the MG iSMART App as a related service. This smartphone app enables:
Remote functions (locking/unlocking, climate control)
Driving data overviews and statistics
Charging planning and range display
Vehicle location and notifications
Data categories processed:
App usage data: account data, login information, interactions within the app
Communication data: connection logs between app, vehicle and server
Service-dependent additional data: notifications, settings, driving statistics
Storage and retention
Data is stored on MG Motor’s European servers (located in Paris, France). Retention ends at the latest upon deletion of the user account.
Contract terms of iSMART services:
The contract begins with activation of the iSMART account and conclusion of an End User Licence Agreement (EULA), as follows:
Services:
Basic services: available for the lifetime of the vehicle
Premium services: separately bookable (generally 12 months, automatically renewable)
Ordinary termination: possible at any time with 30 days’ notice to the end of a month
Extraordinary termination: possible at any time for good cause
Termination by MG Motor:
automatically upon sale of the vehicle
in case of serious breaches of contract after prior warning
if the service is discontinued (with 6 months’ prior notice)
Consequences of termination:
deletion of all stored data within 14 days at the latest
deactivation of remote functions
option to export data before deletion
3. Common Information for Connected Products and Related Services
Access to data
You can access your data as follows:
Directly via the vehicle
certain vehicle data can be viewed directly via the vehicle display and on-board computer functions.
MG iSMART App
access to current vehicle status, driving statistics, energy consumption data, status information, maintenance information.
Individual data requests
for data access requests, onward transfer of data to third parties, or termination of such transfers, please contact dpo@mgmotor.eu.
The data generated and accessible in the use of your vehicle (e.g. vehicle status, location, battery and diagnostic data) generally does not contain trade secrets of MG Motor.
User rights
As a user of a connected MG vehicle, you have the following rights regarding the data generated by the vehicle and related services:
Right to data copy
You may request a complete copy of all data generated and stored by your vehicle and the MG iSMART services at any time. This will be provided free of charge in a common, structured and machine-readable format (e.g. CSV).
Right to data portability
At your request, MG may also transfer the stored data directly to a third party designated by you (e.g. another service provider or workshop). This ensures that you remain in control of who has access to your data.
Right to erasure
You may request the deletion of the vehicle and service data stored by MG at any time, in particular if you terminate your iSMART account or sell the vehicle. Once deleted, the information will be permanently removed, unless MG is legally obliged to retain it for a longer period (e.g. warranty or safety obligations).
Use of vehicle data
MG Motor uses the collected vehicle data for the following purposes:
Provision of the MG iSMART services
Vehicle diagnostics and maintenance notifications
Product development and quality improvement
Customer service and technical support
Compliance with legal obligations (e.g. recall campaigns)
Disclosure to third parties
MG Motor only shares vehicle data with third parties in the following cases:
Where required by law (e.g. to authorities in the context of criminal investigations)
With the explicit consent of the user, to third parties designated by the user
Commercial disclosure of vehicle data to third parties for advertising purposes does not take place.
4. Right to lodge a complaint
You have the right to lodge a complaint with the competent supervisory authority if you believe your rights under the EU Data Act have been violated:
